01Scope
These general terms and conditions (AGB — Allgemeine Geschäftsbedingungen) govern the use of the media intelligence platform mediaintel as well as the public topic portals operated by online360 service GmbH (see legal notice). By using the platform or concluding a client contract, the customer accepts these terms and conditions as binding.
Deviating terms of the customer apply only if they have been acknowledged in writing.
02Services
Within the scope of its offering, online360 service GmbH provides:
- Client platform: AI-powered media monitoring with real-time capture, semantic story clustering, entity and sentiment tracking, outlet comparison, hybrid search and multilingual synthesis — via web UI as well as REST, GraphQL and webhook interfaces.
- Public topic portals: curated, AI-prepared news portals from vetted sources, freely accessible and without tracking.
The exact scope of services, source configuration and number of users per client result from the individual offer or the chosen plan.
03Conclusion of contract & term
Contracts for client access are concluded through a written offer by online360 service GmbH and its acceptance by the customer. The contract term depends on the chosen plan (as a rule monthly or annually) and is extended by the respective period if no notice of termination is given within the agreed period.
The use of the public topic portals by end readers is free of charge and not tied to the conclusion of a contract.
04Prices & payment
The prices stated in the respective valid offer or on /en/b2b apply. All prices are net, plus statutory value added tax. Billing takes place — depending on the plan — monthly or annually in advance via our payment processor Stripe (PCI-DSS certified).
In the event of late payment, online360 service GmbH is entitled to suspend access until the outstanding amount has been settled in full.
05Customer obligations
- Confidentiality of access data and API keys; immediate notification in case of suspected misuse.
- No disclosure of client content to unauthorised third parties.
- Observance of copyright, in particular when passing on aggregated articles or syntheses.
- Compliance with applicable laws as well as the customer's GDPR obligations towards its own data subjects.
06Availability & SLA
online360 service GmbH endeavours to ensure the highest possible availability of the platform. Maintenance windows are announced where possible. Specific service levels (availability, response times, recovery times) depend on the chosen plan and, where promised, are set out in the individual offer.
Interruptions due to force majeure, failures at upstream suppliers or internet providers do not constitute a defect in the service.
07Data protection & DPA
Information on the processing of personal data is contained in the privacy policy. For the processing of personal data in the client context, the parties conclude a data processing agreement (DPA — Auftragsverarbeitungsvertrag) pursuant to Art. 28 GDPR. A standard DPA and TOM (technical and organisational measures) documentation are provided on request.
08Copyright & licences
The content, AI syntheses and software components created by online360 service GmbH are protected by copyright. Any reproduction, adaptation or further distribution beyond the contractually agreed purposes requires written consent.
Image material in the public topic portals originates either from licensed sources (e.g. Wikimedia Commons under the respective indicated licences) or is AI-generated and labelled accordingly. The respective source and licence attribution is located beneath the image in the article.

09Liability
Content is created with the greatest possible care. online360 service GmbH does not warrant the accuracy, completeness and timeliness of the information provided, unless expressly assured. Liability for damages arising from the use or non-use of the platform or of the information provided is — to the extent legally permissible — limited to intent and gross negligence.
Liability for data loss is limited to the typical recovery effort that would have occurred had the customer carried out regular and appropriate data backups.
10Final provisions
Austrian law applies, excluding the UN Convention on Contracts for the International Sale of Goods and the referral norms of private international law. The place of jurisdiction is — to the extent legally permissible — the registered office of online360 service GmbH (LG Wr. Neustadt — Wiener Neustadt Regional Court). Consumers retain the protection afforded by mandatory provisions of their state of residence.
Should individual provisions of these terms and conditions be invalid, the validity of the remaining provisions remains unaffected. online360 service GmbH is entitled to amend these terms and conditions as required; the respective applicable version is available at /en/terms.
